Iowa Code, Section 441.37 (Protest of assessment—grounds) allows that any property owner taxpayer who is dissatisfied with their property's assessment may file a protest with their county's board of review on or after April 16, up to and including May 5, of the year of the assessment. However, Section 441.21, mandates that the burden of proof shall be upon any property owner attacking their valuation as "excessive, inadequate, inequitable or capricious" by offering competent evidence that their assessment is too high.

In Iowa, assessments are re-evaluated every odd-numbered year using real estate sales transacted during the prior calendar year. In 2007, assessments were adjusted using values calculated based on sales in 2006, which was a much better year for real estate sales than 2008. In its 4th Quarter 2008 RealTalk newsletter, the Polk County Assessor stated, “A common perception is that the real estate market has crashed, and that property values have spiraled downward. Thus many people may assume their assessment will be lower in 2009 than it was in 2007 (when the last county-wide revaluation was done). However, for most property owners, that will not be the case.” Of course, the particular challenge faced by Iowa’s county assessors in 2009 is that the market value for many properties has been reduced substantially due to the soft real estate market the past several years, which means that their assessed values should be adjusted comparably.
